MyRide Terms and Conditions
Thank you for using the Regional Transportation District's ("RTD") MyRide Application. RTD's MyRide Application is brought to you by RTD, with sales provided by Masabi LLC ("Masabi"). RTD and Masabi may modify these terms and conditions at any time by posting revised terms and conditions. MOBILE TICKETING AND ACCOUNT-BASED TICKETING
"MyRide App" refers to RTD's MyRide application on an iOS or Android device. "Third-party Application" refers to RTD-authorized third-party mobility applications on an iOS or Android device.
Mobile Ticket or "mTicket" refers to a type of ticket or pass purchased through the RTD MyRide App or Third-party Application. 3-Hour Passes, Day Passes, and Monthly Passes are valid for use on RTD bus and rail services except for Access-a-Ride Services and RTD Special Services, when available. Access-a-Ride tickets are only valid on Access-a-Ride Service.
"Stored Value" refers to funds loaded onto the RTD MyRide application. The "Stored Value Account" is part of the customer account in RTD's MyRide App. Customers can use these pre-loaded Stored Value Account funds as a payment method when purchasing mTickets. Stored value can also be loaded through the online MyRide Web Portal and at RTD sales outlets. Stored value can be used for mTicket purchases through the RTD MyRide App or MyRide website. Stored Value funds in the customer account are not directly valid for travel on RTD service. Customers using mobile tickets must purchase and activate an mTicket to pay the fare. Customers using Tap and Ride QR Codes or MyRide Cards must tap the code or card on the reader in order to pay their fare. The security of your mobile phone, mTicket, Tap and Ride QR Code, and MyRide Card(s) is your responsibility.
"Tap and Ride QR Code" refers to a QR code in the MyRideApp. Customers can generate a QR code in the RTD MyRide App and use funds loaded onto the "Stored Value Account" to pay for fares. Funds are deducted from the "Stored Value Account" when the QR code is tapped onto a reader. The Tap and Ride QR Code is part of the customer account in RTD's MyRide App. Your mobile phone security or Tap and Ride QR Code is your responsibility.
"MyRide Card" refers to a physical contactless card that uses funds loaded onto the "Stored Value Account" to pay for fares, and funds are deducted from the "Stored Value Account" when the card is tapped onto a reader. The MyRide Card can be added to the customer account in the RTD MyRide App for Stored Value Account balance protection and account management, but the MyRide Card is unavailable as a virtual card. The MyRide Card must be tapped on a reader on an RTD revenue vehicle, train platform, or station and presented to a fare inspector, road supervisor, or police officer when requested. Customers can choose not to register their MyRide Card. However, they do not have access to the account management functions in the RTD MyRide App and MyRide Web Portal and can only load funds at RTD sales outlets.
"MyRide Web Portal" refers to a website that customers can use to log into their RTD MyRide App customer account through a web browser. Customers can use this website to create a customer account, manage the account, purchase Stored Value funds, purchase mTickets, add MyRide Cards and discounts, and view the transaction and travel history. The website cannot be used for travel; customers have to activate mTickets in the RTD MyRide App on a mobile device or tap a Tap and Ride QR Code or MyRide Card on a reader to pay their fare.
Your mTicket must be activated before boarding an RTD revenue vehicle. Your Tap and Ride QR code, MyRide Card, or the QR code on an activated mTicket must be tapped on a reader on an RTD revenue vehicle or at a train platform or station and must be displayed clearly on a mobile device screen to the operator every time you board an RTD revenue vehicle or when requested by a fare inspector, road supervisor, or police officer. You cannot print the mTicket or Tap and Ride QR Code or transfer them to other individuals.
RTD recommends that you create an RTD MyRide App account for your protection. If your mobile phone is lost or stolen, you can migrate unused, unexpired mTickets, the Tap and Ride QR Code, and any unused balance on a Stored Value Account to your new mobile device when logging into your customer account on the new device. If you delete the RTD MyRide App, you will also delete your mTickets and Tap and Ride QR Code from your device. If you reinstall the RTD MyRide App on the mobile device it was deleted from and log into your account, your tickets and Tap and Ride QR Code will be downloaded to the device. RTD will not provide a duplicate or replacement mTicket for used or expired mTickets.
Retain the mTicket, Tap and Ride QR Code, or MyRide Card during your entire trip on RTD revenue vehicles. Failure to show an active, valid mTicket, or a Tap and Ride QR Code or MyRide Card that was tapped on a reader less than three hours ago and contains a valid fare product, is considered fare evasion and is subject to enforcement actions according to RTD policy and local and state laws.
You may purchase and activate multiple tickets on the same mobile device for a group riding together. You will have to display an active, valid mTicket for each group member to the operator every time you board an RTD revenue vehicle or when requested by a fare inspector or police officer. The Tap and Ride QR Code and the MyRide Card can only be used as valid fares for one customer. They may not be shared with others and are not transferable. RTD mTickets and Stored Value are sold to you via RTD's Mobile Ticketing and Account-Based Ticketing partner, Masabi. The mTicket, Tap and Ride QR Code, MyRide Card, and loading stored value create a contract between you and RTD to provide the transport services that the mTicket, Tap and Ride QR Code, or MyRide Card allows you to use. It is RTD that provides these transport services to you. In no event will Masabi or any third-party mobile app ticket seller be responsible for or have any liability to you concerning these transport services or their availability or performance (including your use or access to any RTD revenue vehicle, the RTD network, your use of any services provided under your mTicket, or for your use of the RTD Mobile Tickets App, Tap and Ride QR Code, MyRide Card, or MyRide Web Portal.
RTD MYRIDE APPLICATION
RTD grants you the right to download, install and use the RTD MyRide App on your mobile device to purchase mTickets, load Stored Value, use the Tap and Ride QR Code or MyRide Card, and access information in accordance with these terms and conditions. RTD also grants you the right to use the RTD MyRide Web Portal. You do not and will not own the RTD MyRide App or MyRide Web Portal or any information that is provided to you through them or RTD. You may use the application in accordance with these terms and conditions solely for the purposes of purchasing and using mTickets, loading Stored value, using a Tap and Ride QR Code or MyRide Card, managing your Customer Account, and accessing transport information for your personal use and not for any other purpose. You may use the MyRide Web Portal in accordance with these terms and conditions solely for the purposes of purchasing mTickets, loading Stored value, and managing your Customer Account and not for any other purpose. The RTD MyRide application, MyRide web portal, Tap and Ride QR Codes, and MyRide Cards are provided to you free of charge. However, RTD can suspend access to purchasing mTickets, loading Stored Value, using the Tap and Ride QR Code or MyRide Card, and managing your Customer Account and can do so for any reason.
THIRD-PARTY APPLICATION CHANNEL SALES
Currently, the only RTD-authorized Third-party Applications that fulfill RTD mTickets are the Uber, Lyft, and Transit apps. The RTD MyRide App and the Third-party Applications are wholly different and separate applications, governed by separate Privacy Policies and Terms and Conditions of Use, which you can review on the respective applications. Login credentials and accounts between the RTD MyRide App and the Third-party Applications are not shared. Your RTD MyRide App account is different from your Third-party Application account. Your RTD MyRide App ticket wallet only stores RTD mTickets purchased from the RTD MyRide App. Your ticket wallet in a Third-party Application only stores RTD mTickets purchased from the Third-party Application. RTD mTickets purchased in the Third-party Application will only be available in the Third-party Application. RTD mTickets purchased in the RTD MyRide App will only be available in the RTD MyRide App and are not transferable to a Third-party Application.
RTD Stored Value Accounts and use of the funds are only available in the RTD MyRide App. RTD Stored Value Accounts They are not available in Third-party Applications and funds are not transferable to a Third-party Application.
RTD mTickets, Tap and Ride QR Codes, and MyRide Cards are only valid for fare payment on RTD transit services and cannot be used towards mobility services offered by Third-party Applications. Other mobility services, such as ride-hailing, scooters, and bike-sharing services, are unavailable in the RTD MyRide App. RTD mTickets purchased in a Third-party Application will be sold to you by RTD through its fare collection partner, Masabi, in the Third-party Application. RTD Stored Value Accounts, the Tap and Ride QR Code and the MyRide Cards are unavailable in third-party applications.
PRICES AND RECEIPTS
When you purchase an mTicket or load value to your Stored Value Account, the RTD Mobile Tickets App or MyRide Web Portal will notify you of the price before confirming your purchase. Once you complete your purchase, a receipt will be emailed to the email address you provided. The fare cost deducted from your Stored Value account by tapping the Tap and Ride QR Code or MyRide Card on a reader will be available in the app or MyRide Web Portal under Travel History. DISCOUNT FARES (NOT APPLICABLE FOR ACCESS-A-RIDE SERVICES)
Discount fares apply to seniors 65+, individuals with disabilities, and Medicare recipients. Youth discount fares apply to youth ages 6-19 (up to three children ages five and younger ride free with a fare-paying adult). LiVE discount fares are available for low-income individuals enrolled in the RTD LiVE Program.
Proof of eligibility is required for all passengers using discounted fare products. Active duty members of the U.S. military ride free on all RTD services. Individuals with disabilities may obtain a Special Discount Card by calling 303.299.2667. The unauthorized use of discounted fare products is a form of fare evasion and will be enforced according to RTD policy and local and state laws. ACCESS-A-RIDE TICKETS
The Access-a-Ride tickets are available for individuals with disabilities enrolled in the RTD Access-a-Ride Program. An RTD Access-a-Ride identification card as proof of eligibility for all passengers using Access-a-Ride fare products is required. The Access-a-Ride ticket is good for one-way travel on Access-a-Ride Service only; not valid on any other RTD services. For more information on Access-a-Ride fares, please visit the RTD web page at rtd-denver.com/routes-services/other-services/access-a-ride. In the case of Access-a-Ride Service, an aide who accompanies a passenger with a disability may ride for free. The Tap and Ride QR Code and the MyRide Card are unavailable for Access-a-Ride Service.
DATA CHARGES AND CONNECTIVITY
The RTD MyRide App is free, but you may incur data charges from your cell phone network provider. You are responsible for any such costs. RTD will not take responsibility for any connectivity issues you may experience.
AVAILABILITY & UPDATES
Travel is based on fare applicability on RTD services at the time of purchasing a ticket, using a Tap and Ride QR Code, or using a MyRide Card. Once purchased, the mTicket will specify the fare type and the ticket's validity. Once activated and used, the fare type and mTicket's validity will be available in the history in the RTD MyRide App and the MyRide Web Portal. After a Tap and Ride QR Code or MyRide Card are tapped on a reader, the fare type and fare product validity will be available in the Travel History in the RTD MyRide App and the MyRide Web Portal.
RTD reserves the right to issue updates to the RTD MyRide App, in which case you may not be able to continue using the version of the RTD MyRide App installed on your mobile device without downloading the latest update. Therefore, RTD recommends that you download and install all updates issued. RTD is not liable for errors that become apparent in old versions of the RTD MyRide App.
CHANGES, REFUNDS, AND REPLACEMENTS
All sales are final. mTickets will only be replaced under special circumstances, including but not limited to service disruptions of the RTD MyRide App. RTD will not issue duplicate or replacement tickets for mTickets used without your permission and will not replenish funds in a Stored Value Account used without your consent by a person to whom you have given access to your mobile device or customer account. If the mTicket is damaged or is not readable, it becomes invalid; you must purchase a new ticket.
The decision to change, cancel, refund, or replace an mTicket is at RTD's sole and absolute discretion. Neither RTD nor Masabi shall be obliged to change, cancel, or replace an mTicket when RTD has reason to believe that the circumstances prompting the change, cancellation, or replacement is the result of fraud. If an mTicket was purchased using funds from a Stored Value Account, any refund returns the value to the Stored Value Account. RTD will not provide a cash reimbursement under any circumstances. Please note that refunds shall be for only the mTicket(s) price. Any other associated fees are non-refundable. If a customer used a Stored Value Account to ride with a Tap and Ride QR Code or MyRide Card, any refund returns the value to the Stored Value Account. RTD will not provide a cash reimbursement under any circumstances.
Stored Value Accounts with no activity (addition of funds, purchase of mTickets, use of Tap to Ride QR Codes or MyRide Cards for travel) for five years are considered Dormant. RTD will transfer the remaining Stored Value Account balance to the State of Colorado according to the Colorado Unclaimed Property Act.
MATERIALS, OWNERSHIP, AND RESTRICTIONS ON USE
RTD offers the RTD MyRide App, MyRide Cards, and access to purchase and account management functionality through the MyRide Web Portal. RTD or its third-party licensors either own them (including without limitation, Masabi) and any data, text, graphics, images, audio and video clips, logos, icons, software and links, and any intellectual property and other rights relating thereto, are and will remain the property of RTD or Masabi or their respective licensors. You may not copy, reproduce, republish, upload, post, transmit or distribute the RTD MyRide App or any of its content without the prior written permission of RTD and its licensors. Nor may you: (i) reverse engineer, decompile or seek to obtain the source code to the RTD MyRide App except where and to the extent expressly required to be permitted by applicable law; or (ii) make or seek to make derivative works based on the RTD MyRide App. By using or downloading the RTD MyRide App, using the MyRide Web Portal, or obtaining a MyRide Card, you agree to these terms and conditions. The RTD MyRide App, MyRide Cards, and MyRide Web Portal are supplied to you by RTD, and neither Masabi nor any of RTD's other third-party licensors shall have any liability to you arising out of or in connection with them.
Colorado law applies to these terms and conditions, and users agree that any dispute between RTD and the users of the RTD MyRide App, Stored Value Accounts, MyRide Cards, and MyRide Web Portal regarding the RTD Mobile Tickets App, sales of RTD mTickets, sales of Stored Value, usage of Stored Value for purchase of mTickets or for fare payment with Tap and Ride QR Codes and MyRide Cards, or arising out of or in connection with these terms and conditions will be in Denver District Court, Colorado.
DISCLAIMER OF WARRANTIES
RTD and Masabi expressly disclaim any representation or warranty, express or implied, including, without limitation, any implied or express warranty of merchantability or fitness for a particular purpose, and any warranties regarding the security, reliability, timeliness, and performance of the RTD MyRide App, MyRide Cards, and MyRide Web Portal.
LIABILITY DISCLAIMER
In no event will RTD, its employees, directors, and agents be liable to you or to any third-party for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind directly or indirectly arising out of or related to your use or access to the RTD MyRide App, MyRide Cards, and MyRide Web Portal, including loss of data, loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise. In no event will Masabi be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of or in connection with your use or access to any mTicket or the RTD MyRide App, MyRide Cards, and MyRide Web Portal, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise. Neither RTD nor Masabi shall be liable for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the RTD Mobile Tickets App or use of the MyRide Web Portal, or purchase of any mTicket or Stored Value, and use of mTickets, Tap and Ride QR Codes, or MyRide Cards. Nothing in these terms and conditions shall exclude or limit a person's liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.
RTD is a statutory political subdivision of the State of Colorado and is subject to the Colorado Governmental Immunity Act, C.R.S. § 24-10-101, et seq. Nothing in these terms and conditions shall be construed as an express or implied waiver by RTD of its governmental immunity including limitations of amounts, types of liability, or governmental acceptance by RTD of liabilities arising as a result of actions which lie in tort or could lie in tort in excess of the liabilities allowable under the Colorado Governmental Immunity Act.
INDEMNIFICATION
You agree to indemnify and hold RTD, its employees, directors, and agents and Masabi harmless from and against any all claims, damages, losses, costs, expenses, or liabilities relating to, arising from, or as a result of your use or access to the RTD MyRide App, MyRide Web Portal, and MyRide Cards. You agree to pay any costs, including reasonable attorneys' fees, incurred by RTD to enforce these terms and conditions.
PRIVACY
The collection, use, and security of information obtained from customers using RTD mTickets, Tap and Ride QR Codes or MyRide Card are subject to RTD's MyRide Privacy Policy, as may be amended from time to time, as deemed necessary by RTD, and is posted on the RTD website at rtd-denver.com/fares-passes/mobile-ticketing/mobile-ticketing-privacy-policy.
